Divorce
In order to file for divorce in Arizona, the spouses must show that one of them was domiciled in the state and that the marriage was irretrievably broken. If the marriage was a "covenant marriage" under Arizona law, the grounds for divorce include:
- Adultery
- A spouse has been sentenced to death or imprisonment for a felony
- Abandonment for at least one year
- Physical abuse, sexual abuse, domestic violence, or emotional abuse by one spouse of the other, a child, or a relative permanently residing in the matrimonial home
- The spouses have been living separate and apart continuously without reconciliation for at least two years
- The spouses have been living separate and apart continuously without reconciliation for at least one year from the date of legal separation
- Habitual drug or alcohol abuse
- Both spouses agree to a dissolution of marriage
Once divorce proceedings have begun, the court with jurisdiction may also determine many other family law issues, such as child custody, visitation, and support; spousal support or alimony; the division of community property and debts; or issues of relocation.
